Booking Bot provides AI-powered lead engagement and appointment booking services for home service contractors. Our platform helps convert leads into booked appointments through automated communication.

We reserve the right to modify, suspend, or discontinue the Service at any time with or without notice.

3. User Accounts and Registration

To access certain features of our Service, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account

You are responsible for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws or regulations
  • Transmit any harmful, threatening, abusive, or harassing content
  • Impersonate any person or entity or misrepresent your affiliation

5. Payment and Billing

Our Service operates on a performance-based pricing model. You pay only for qualified appointments that we successfully book for your business.

Payment Terms:

  • No upfront fees or monthly retainers
  • Payment is due only upon successful appointment booking
  • Billing occurs monthly for appointments booked in the previous month
  • Payment is due within 30 days of invoice date

All fees are non-refundable once services have been rendered.

6. Territory Protection

We provide exclusive territory protection, ensuring only one contractor per service area. This exclusivity is maintained as long as you remain an active customer in good standing.

Territory boundaries are defined at the time of service initiation and may be adjusted by mutual agreement.

7. Data and Privacy

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You retain ownership of any data you provide to us. We may use this data to provide and improve our services, train AI models, and fulfill our obligations under these Terms.

We implement appropriate technical and organizational measures to protect your data.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Booking Bot LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works of our Service without express written permission.

9. Service Availability

While we strive for high availability, we do not guarantee that the Service will be available at all times. The Service may be unavailable due to maintenance, updates, or circumstances beyond our control.

We are not liable for any losses resulting from Service unavailability.

10. Limitation of Liability

To the maximum extent permitted by law, Booking Bot LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid to us in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Booking Bot LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

13. Termination

Either party may terminate this agreement at any time with written notice. We may also terminate or suspend your account immediately for cause, including violation of these Terms.

Upon termination, your right to use the Service ceases immediately, but obligations incurred prior to termination remain in effect.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States and the state in which Booking Bot LLC is incorporated, without regard to conflict of law principles.

15. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

You waive any right to participate in class action lawsuits or class-wide arbitrations.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be posted on our website with an updated effective date.
